Terms of Use
Last updated: 15 October 2026
1. Who this agreement is with
These Terms of Use ("Terms") are a contract between you and Kai Ali Kutsalcan ("we," "us," "The Selection"), an individual residing in Germany, regarding your use of the The Selection mobile application (the "App") and any related services.
By creating an account or using the App, you agree to these Terms. If you don't agree, don't use the App.
2. Eligibility
You must be at least 16 years old to create an account. The App is not directed at children and we do not knowingly collect personal information from children under that age.
3. Your account
- You're responsible for keeping your login credentials (password, or passkey/biometric access on your device) secure.
- You may sign in with email/password, Sign in with Apple, or Google Sign-In. However you sign in, you're responsible for all activity under your account.
- You can delete your account and associated data at any time from Settings (this permanently removes your profile, brew logs, pantry, and gear data from our servers).
4. Subscriptions and billing
- The App offers a free tier and a paid premium subscription ("Premium"), including a 7-day free trial for new premium subscribers.
- All payments are processed by Apple (App Store) or Google (Play Store), not directly by us — their respective terms and billing/refund policies govern the transaction itself. We never see or store your payment card details.
- Premium status (or an active trial) is what unlocks the "Try Brew" one-tap recipe clone in the Community feed and any other feature marked premium in the App. Recipe content shared by other users in the Community feed is visible to all users regardless of subscription status.
- Subscriptions auto-renew unless cancelled through your Apple/Google account settings at least 24 hours before the renewal date. Cancelling does not retroactively refund the current period.
5. Community content ("User Content")
The App lets you post brew logs, ratings, notes, and (in future) photos publicly to a Community feed that other users can see, like, and follow.
- You own what you post. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute it within the App for as long as your content remains public. This license ends when you delete the content or your account, except for content already shared with other users (e.g. already visible in someone's feed).
- You're responsible for what you post. Don't post anything illegal, infringing, harassing, or content you don't have the right to share (e.g. a photo you didn't take).
- We do not pre-screen posts. Public content may be automatically filtered for prohibited language and can be reported by other users; reported content is removed from public feeds immediately upon the first report and stays hidden pending review by our moderation team. See our Community Guidelines for details.
- We may remove content or suspend accounts that violate these Terms, without prior notice.
- Content retention for reported material. Content that has been reported and is pending or has been denied moderation review is not deletable by you while it remains under review — we retain it (rather than allowing it to be deleted) in case it needs to be preserved as evidence or disclosed to law enforcement or other authorities as legally required. Once content is approved by moderation review, normal deletion rules resume.
- Using your data to train our suggestion model is separate, and opt-in. The license above covers hosting and displaying your public content within the App — it does not by itself cover using your brew data (recipes, ratings, bean details) to train the machine-learning model behind our recipe suggestions. We only do that if you separately say yes to it (off by default; ask us again anytime in Settings) — see our Privacy Policy for exactly what that involves. Declining doesn't affect your ability to post, or to receive suggestions based on your own brew history and community favorites.
6. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or to violate any applicable law.
- Attempt to access other users' accounts or data without authorization.
- Reverse-engineer, decompile, or attempt to extract source code from the App, except where applicable law permits it.
- Use automated means (bots, scrapers) to access the App or its API.
- Post spam, affiliate links (except where the App itself provides official rebuy links, per Section 5), or misleading content.
7. Affiliate links
Some coffee entries in the App show a "Buy again" or "Get selection" link to a retailer. These are curated by us. Where a link is an affiliate link, we label it as an ad right next to the link, and we may earn a commission on purchases made through it. This does not affect the price you pay.
8. Disclaimers
- The App is provided "as is." Brewing recipes, grind recommendations, and predictive suggestions are provided for informational purposes and are not guaranteed to produce any particular result.
- We are not responsible for the accuracy of user-generated content (including affiliate-linked third-party coffee vendors' products, availability, or pricing).
- Location data we gather (only if you opt in) is anonymized. We resolve it to a coarse country code on your own device and never store it against your account — see our Privacy Policy for exactly how.
9. Limitation of liability
To the maximum extent permitted by law, Kai Ali Kutsalcan is not liable for indirect, incidental, or consequential damages arising from your use of the App. Nothing in these Terms limits our liability for intent or gross negligence, for injury to life, body or health, or for anything else that cannot be limited under applicable law.
10. Termination and account suspension
We may suspend or terminate your access to the App if you violate these Terms, including by posting prohibited content or repeated violations flagged through our reporting system. A suspended ("banned") account is immediately signed out of all active sessions and cannot sign back in, refresh its session, or post, like, or report content until the suspension is lifted. We may do this without prior notice for serious or repeated violations. You may stop using the App and delete your account at any time.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email before they take effect.
12. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law principles. If you are a consumer, you also keep the protection of the mandatory consumer-protection laws of the country where you live.
